By using McReginald Denis Mobile Notary services, you acknowledge that you have read the following Terms of Use and that you accept and agree to be bound by them. The client (entity placing the order via email or calling) is responsible for payment for travel regardless of whether or not the loan closes and/or document is completed. Client is also responsible for all shipping costs. Although our basic prices are fairly standard, each signing is evaluated on an individual basis and may vary in price due to special circumstances. Extra fees may apply for e -mailed and faxed docs. Additional fees may apply for a second set of docs (more than one loan), borrower’s copies, bilingual notaries or special pick-up and/or drop -off fees. Should McReginald Denis Mobile Notary, or any of its agents, be found in error by us and have to return to the borrowers to correct the problem, corrections will be made at no extra charge.
If McReginald Denis Mobile Notary, or any of its agents, must return to the borrowers for reasons unavoidable by McReginald Denis Mobile Notary or any of its agents, such as, but not limited to, documents missing from the original batch, changes requested by the borrowers, corrections made to the original documents, and or having to reschedule due to the borrowers or signers not being home at the pre-agreed date and time or having to travel to additional destinations for additional borrowers or signers, additional trip(s) will be considered as another signing travel charge for which an additional fee for each trip will apply. If McReginald Denis Mobile Notary is to pick up the documents, we ask that you call to confirm pickup after the documents are ready, otherwise you may be charged a waiting fee. To avoid cancellation charges, client must give McReginald Denis Mobile Notary cancellation notice within a reasonable amount of time prior to the appointment. If McReginald Denis Mobile Notary service agent has already begun the process (including travel to pick up docs); the full amount of the original signing fee will apply. If e-Mail or faxed documents have already been printed prior to cancellation, corresponding print fees will apply. To avoid costly mistakes, McReginald Denis Mobile Notary service recommends that you consider the time needed to prepare and print loan documents and travel time to the borrowers prior to setting a closing time you with your borrowers. It is always recommended that you allow McReginald Denis Mobile Notary service to schedule the closing time with your borrowers.
Between the hours of 8:00a.m. And 8:00p.m., 7 days a week, one of our mobile notary signing agents will travel to the location of your choice and be charged as a regular rate from our Fee Schedule. From the hours of 8:00 pm to 8:00am, 7 days a week one of our mobile notary signing agents will travel to the location of your choice and be charged an after hours surcharge. Once an agent confirms departure time client will be liable for all charges agreed upon. In order to cancel, Client must Contact McReginald Denis Mobile Notary services at 561-452-0290 within four (4) hours of the appointment time.
Payment terms are net upon receipt of invoice unless agreed upon. Payment is due within 24 hours of signing date. If payment in full is not received within 24 hours of signing, late fees of 18% or $20.00 dollars per a 5 business day week whichever is greater from the date of signing will be applied to the open balance. Within 15 days of nonpayment, addition to collection costs and any applicable attorney fees will be applied. The Client and or its associates agree not to attempt to contact any of McReginald Denis Mobile Notary “Signing Agents, Agents, or affiliates” directly for any reason in regards to the current assignment and/or any future signings, nor will the client engage directly in any business with any of McReginald Denis Mobile Notary’s “Signing Agents” without McReginald Denis Mobile Notary knowledge and expressed consent in writing. In the event of arbitration or litigation, all fees including but not limited to attorney fees and court costs along with all incurred expenses, will be paid by the prevailing party. These Terms of Use will be governed by and construed in accordance with the laws of the United States of America and the State of Florida without regard to conflict of law principles. Users agree that all legal proceedings related to the matters herein shall be adjudicated solely in the courts of Palm Beach County, Florida, United States of America. To the extent any portion of these Terms of Use shall be determined to be unenforceable by a court of competent jurisdiction, such portion will be modified by the court solely to the extent necessary to cause such portion to be enforceable. These Terms of Use as so modified will remain in full force and effect. Any waiver of any provisions contained in these Terms of Use by McReginald Denis Mobile Notary shall not be deemed to be a waiver of any other right, term, or provision of these Terms of Use. This agreement supersedes any previous written or verbal agreements and applies to all services prior to or after the execution of this agreement. A fax copy of this agreement does NOT invalidate its enforce-ability.
