I9 Verification form is used for verifying the identity and employment authorization of individuals hired for employment in the United States. All U.S. employers must ensure proper completion of an I9 Verification form for each individual they hire for employment in the United States. This includes citizens and non-citizens. Both employees and employers (or authorized representatives of the employer) must complete the form. On the form, an employee must attest to his or her employment authorization. The employee must also present his or her employer with acceptable documents evidencing identity and employment authorization. The employer must examine the employment eligibility and identity document(s) an employee presents to determine whether the document(s) reasonably appear to be genuine and to relate to the employee and record the document information on the I9 Verification form.

A Notary Public can be a viable option for completing an I9 Verification form  for remote hires; but not because of their official position. Employers often direct their new remote hires to contact a Notary because they are easy to find, and because notaries are accustomed to identifying their clients, reviewing official documents and witnessing signatures.

It’s important to note that some states, such as Texas for instance, prohibit notaries from completing I9 Verification forms on behalf of employers. Notaries must educate and familiarize themselves with their respective state’s laws governing the completion of I-9 forms before agreeing to the service. This information can typically be found through the Secretary of State’s office.
